Defending the foreclosure is critical in buying a borrower time to pursue a loss mitigation strategy of loan modification, short sale or deed-in-lieu of foreclosure. A solid defense may also earn the borrower ``cash for key`` or quit title.
Mortgage modifications under HAMP typically include 40 year terms at interest rates as low as 2%. If a borrower is denied modification under HAMP, many lenders offer private modifications. The bankruptcy court also offers a modification program that is highly successful.
Avoiding a foreclosure through a short sale is much more benefisial for a borrower's credit. In addition, lenders will often agree to waive deficiencies and even offer relocation incentives and ``cash for keys``.
